1. Introduction and Acceptance

Welcome to Travella Stays (“Travella Stays,” “Travella,” “we,” “us,” or “our”), the curated hospitality and travel-experiences brand owned and operated by Elixir Retails LLP, a limited liability partnership organised under the laws of India (the “Company”). These Terms of Service (“Terms”) govern your access to and use of the website located at https://www.travellastays.com/ (the “Site”), together with any bookings, purchases, content, and services made available through it (collectively, the “Services”).

By accessing or using the Site or the Services, creating an account, making a booking, or purchasing any product through the Site, you (“you,” “your,” or “Guest”) agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, please do not access or use the Site or the Services.

2. About Travella Stays

Travella Stays is a brand name of Elixir Retails LLP. Every reference to “Travella Stays,” “Travella,” or “we” in these Terms refers to Elixir Retails LLP, the legal entity responsible for the Site and the Services.

Travella Stays curates boutique stays and experiences across Northeast India, including cultural performances, wildlife safaris, bonfire evenings, and river rafting, and may also list certain properties or experiences on third-party platforms such as Airbnb and MakeMyTrip. Bookings made directly through those third-party platforms are governed by that platform's own terms, in addition to these Terms where applicable.

3. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract under the Indian Contract Act, 1872, to make a booking or purchase through the Site. By using the Site, you represent and warrant that you meet these requirements. Bookings made on behalf of minors or a group must be made by an adult who accepts full responsibility for every member of the party.

4. Accounts and Registration

Certain features of the Site, including saved bookings, order history, and member benefits, may require you to register for an account. You agree to provide accurate, current, and complete information when creating an account and to keep this information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately at hello@travellastays.com if you suspect any unauthorised use of your account.

5. Bookings, Reservations, and Payments

5.1 Booking Confirmation. A booking or reservation is confirmed only upon our written or system-generated confirmation (such as a confirmation email or invoice) following successful payment. Availability and pricing displayed on the Site are subject to change without notice until a booking is confirmed.

5.2 Payment. Full payment (or a deposit, where specifically offered) is due at the time of booking, through the payment methods made available on the Site. All prices are listed in Indian Rupees (INR) unless stated otherwise, and are inclusive or exclusive of applicable taxes as indicated at checkout.

5.3 Accuracy of Information. You are responsible for providing accurate guest details, travel dates, and contact information. Travella Stays is not liable for any loss or additional cost arising from inaccurate information you provide.

5.4 Third-Party Experience Providers. Certain experiences (including safaris, rafting, and cultural performances) may be operated or supplied by independent local vendors and partners. Travella Stays coordinates these experiences on your behalf but is not itself the operator of such third-party activities, which may carry their own safety guidelines, waivers, and terms.

6. Cancellations and Refunds

6.1 General Policy. Except as expressly stated otherwise at the time of booking, or as set out below, all bookings, reservations, and purchases made through the Site are non-refundable and non-transferable once confirmed. This includes, without limitation, accommodation bookings, curated experiences, event tickets, and store purchases.

6.2 No Refunds For. No refund or credit will be issued for early check-out, late arrival, unused nights, unused experiences or activities, or failure to arrive (“no-show”), regardless of the reason.

6.3 Limited Exceptions. Refunds, credit, or rescheduling may be granted, at our sole discretion, in the following circumstances:

Travella Stays cancels, or is unable to fulfil, a confirmed booking for reasons within our control;
A Force Majeure Event (as defined in Section 15) makes performance impossible; or
A refund is required under applicable Indian consumer protection law.

6.4 Rescheduling. Where we agree to reschedule a booking, this is subject to availability and may be subject to a rate difference or rescheduling fee, at our sole discretion.

6.5 Method and Timing of Refunds. Where a refund is approved, it will be processed to the original payment method within a reasonable time, less any non-recoverable transaction or processing fees.

6.6 Third-Party Bookings. Bookings made through Airbnb, MakeMyTrip, or any other third-party platform are subject to that platform's own cancellation and refund policy, and not to this Section 6.

7. Pricing, Availability, and Promotions

We make reasonable efforts to ensure that pricing and availability shown on the Site are accurate, but errors may occur. We reserve the right to correct any pricing or availability error, cancel an affected order, and issue a refund where a booking was accepted at an incorrect price, provided this occurs before the confirmed date of stay or experience. Promotional codes and discounts are subject to their own stated terms and may be withdrawn or modified at any time.

8. User Conduct

When using the Site or participating in any Travella Stays experience, you agree not to:

provide false, misleading, or fraudulent information;
use the Site or Services for any unlawful purpose or in violation of these Terms;
interfere with or disrupt the security, integrity, or performance of the Site;
attempt to gain unauthorised access to any account, system, or network connected to the Site;
harass, endanger, or act abusively toward Travella Stays staff, partners, vendors, or other guests; or
copy, scrape, or reproduce Site content for commercial purposes without our prior written consent.

9. User Content

If the Site permits you to submit reviews, comments, photographs, or other content (including through forms, blog comments, or the Members Area), you grant Travella Stays a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, display, and distribute that content in connection with operating and promoting the Site and our Services. You represent that any content you submit is your own original work, or that you otherwise have the right to submit it, and that it does not infringe any third party's rights.

10. Intellectual Property

All content on the Site, including the Travella Stays name, logo, photographs, graphics, text, and design, is the property of Elixir Retails LLP or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written consent, except for your own personal, non-commercial use of your booking confirmation or invoice.

11. Third-Party Links and Services

The Site may contain links to, or integrate with, third-party platforms and services, including but not limited to Instagram, payment processors, and travel platforms such as Airbnb and MakeMyTrip. We do not control, and are not responsible for, the content, policies, or practices of any third-party site or service. Your use of any third-party service is at your own risk and subject to that third party's own terms and privacy policy.

12. Disclaimers

The Site and Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any experience or activity will meet your expectations.

Outdoor experiences such as safaris, rafting, and bonfire evenings carry inherent risks. You participate in these activities voluntarily and at your own risk, subject to any specific waivers or safety instructions provided by the relevant operator.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Elixir Retails LLP, its partners, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site or the Services. Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the total amount actually paid by you to us for the specific booking or purchase giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless Elixir Retails LLP, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these Terms, your misuse of the Site or Services, or your violation of any applicable law or third-party right.

15. Force Majeure

Neither party shall be liable for any failure or delay in performance under these Terms resulting from causes beyond its reasonable control, including but not limited to natural disasters, extreme weather, government action, civil unrest, strikes, pandemics, or regional infrastructure disruptions (a “Force Majeure Event”). Where a Force Majeure Event affects a confirmed booking, we will work with you in good faith on rescheduling or credit options where reasonably possible.

16. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, available on the Site, which is incorporated into these Terms by reference. By using the Site, you consent to the collection and use of your information as described in that Policy.

17. Changes to These Terms

We may update or modify these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. The updated Terms will be posted on the Site with a revised “Effective Date.” Your continued use of the Site after any such change constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

18. Termination

We reserve the right to suspend or terminate your access to the Site or any account, and to cancel any pending booking, at our discretion, if we believe you have violated these Terms, engaged in fraudulent activity, or posed a risk to Travella Stays, its staff, partners, or other guests.

19. Governing Law and Jurisdiction

These Terms, and any dispute arising out of or in connection with them (including non-contractual disputes), shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-laws principles. Subject to Section 20 (Dispute Resolution), the courts of competent jurisdiction in Assam, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.

20. Dispute Resolution

We encourage you to first contact us at hello@travellastays.com to resolve any concern informally. If a dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through the courts identified in Section 19 or, where both parties agree in writing, through arbitration seated in Assam, India, conducted in English in accordance with the Arbitration and Conciliation Act, 1996.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

22. Entire Agreement

These Terms, together with our Privacy Policy and any specific booking terms provided to you at the time of purchase, constitute the entire agreement between you and Elixir Retails LLP regarding your use of the Site and Services, and supersede all prior agreements and understandings on this subject.
